Internet Access for Guests at the University of Zurich - Terms of Use

1. Subject matter and scope

1 These terms and conditions of use of the University of Zurich (hereinafter UZH) govern the rights and obligations in connection with the use of internet access for guests at the UZH.

2 UZH provides its guests with internet access subject to the following conditions:

1 The UZH provides guests who bring their own wireless LAN (WLAN)-enabled terminal equipment with free Internet access at selected locations and within the scope of its technical, operational and economic possibilities. Guests are not entitled to access to the Internet.

2 UZH may at any time call in third parties as vicarious agents to provide its services.

3 UZH does not guarantee any specific quality, functionality or freedom from interference in the transmission of data.

4 Internet access does not grant guests access to the UZH's internal network.

3. Guest obligations and prohibited actions

1 Before using Internet access for guests, the user is obliged to register for use and accept the validity of these terms of use. In order to use the Internet access, the guest must register his terminal device. It is possible to register several terminal devices per guest for the use of the network. The system requires the guest to enter the mobile phone number. The MAC address of the used terminal device is automatically assigned to the specified mobile phone number. The registration must be renewed every 6 months. UZH reserves the right to require individual or all guests to re-register at any time.

2 The guest must use state-of-the-art software (in particular antivirus software) to ensure that the terminals he/she uses and the software on them are free of malware as far as technically possible.

3 The guest is obliged to use UZH's Internet access properly and lawfully.

4 The guest is expressly prohibited from misusing or allowing guests to misuse the Internet access facilities or to use them to commit illegal or criminal acts. The guest is responsible for the content that he/she enters, distributes or retrieves via the Internet access for guests. In doing so, the guest is prohibited from any actions when using the Internet access that violate applicable law or official orders and/or infringe the rights of third parties. In particular, the following actions are prohibited:

  • Setting, distributing, offering and advertising pornographic, violence glorifying or racist contents or designs;
  • posting, distributing, offering and advertising content or designs that violate data protection laws and/or other laws and/or contain fraudulent content, services or products;
  •  Publish or make available content that insults or defames third parties;
  • The use, provision and/or distribution of content, services and/or products in which third party rights exist (in particular trademark rights, copyrights, design rights, patent rights) as well as anti-competitive actions, in particular the making available to the public and/or reproduction of works protected by copyright or other acts contrary to copyright, as well as aiding and abetting acts in this respect;
  • sending junk mail or mass mail (spam);
  •  spreading viruses, Trojan horses, spyware and other harmful programs or files (malware);
  • Registration with one's own mobile phone number for the benefit of third parties;
  • Sharing Internet access with third parties (e.g. by locally connecting several terminal devices).

4. Blocking of Internet access

1 UZH has the right to temporarily or permanently block access to the network at any time if there are indications that a guest is or will be in breach of these terms of use and/or applicable law or official regulations.

2 In the event of excessive use by a guest, UZH may limit the guest's bandwidth or exclude the guest entirely from using Internet access.

5. Liability of the guest

1 The guest is responsible for all actions he/she takes in connection with the use of the network. Use of the Internet access is at the guest's own risk.

2 The guest shall indemnify UZH and its vicarious agents against all claims made by third parties against UZH due to a breach by the guest of statutory provisions, third party rights and/or contractual obligations. This also includes the costs of any necessary legal defence.

3 The guest is obligated to cooperate in establishing the facts of the case.

6. Data protection declaration

1 In order to provide guests with free Internet access, UZH collects and stores the following end user data when guests register to use the network:

  • Mobile phone number
  • MAC and IP address of the terminal device
  • Browser data: Browser type, operating system and language
  • Date of registration
  • Time of last login.

2 While the network is in use, UZH also collects and stores the following marginal data:

  • Host name (name of the terminal device)
  • Manufacturer of the terminal equipment
  • Used WLAN transmitter
  • Radio channel, quality of the WLAN connection and neighbouring WLAN transmitters
  • Connection time (how long is the connection active)
  • Source IP address and port of the IP connections
  • Destination IP address and port of the IP connections
  • Service used (e.g. SSL, CIFS, Youtube, Dropbox, google-services etc.)
  • Times at which the IP connections are established and terminated
  • Transferred data volume of the IP connections.

3 This data is stored and processed for the following purposes::

  • Provision of the service
  • Troubleshooting
  • Detection of misuse
  • Enabling identification in case of misuse
  • Storage of the marginal data within the framework of the regulations.

4The registration and marginal data are stored for a period of 6 months from the end of use on the facilities of the Central IT of the UZH in Switzerland.

5 Personal data will only be disclosed to third parties (e.g. to other authorities) if this is required by mandatory legal provisions (e.g. official requests, court orders) or for the purpose of legal or criminal prosecution (e.g. in the event of abuse). Disclosure to third parties for other purposes does not take place.erforderlich ist. Eine Bekanntgabe an Dritte zu anderen Zwecken findet nicht statt.

6 Notwithstanding the above, the UZH may commission service providers to further process the data collected for the above-mentioned purposes. UZH and the commissioned third party service providers are obliged to ensure compliance with data protection regulations by means of legal, technical and organisational measures.

7 The Data Protection Law Department is responsible for requests from guests for information on the personal data collected or for the correction, destruction or blocking of this data. Corresponding inquiries should be sent in writing to the following address:

7. Security

1 Use of the Internet access is at the guest's own responsibility. The guest is solely responsible for the security of his/her terminal device.

2 The registration and login to the guest portal is carried out via a data connection (HTTPS) that is sufficiently encrypted according to the state of the art. The data traffic generated after the registration between the guest's terminal device and the access point (and also the end point of the connection) is transmitted unencrypted, depending on the application protocol used (HTTP instead of HTTPS for websites, IMAP instead of IMAPS for e-mail reception, etc.). Data on the way between the end device and the end point of the established connection can therefore possibly be viewed by third parties. Further security of the data traffic can only be achieved by using special security software (typically through a VPN), which the guest must operate himself. UZH does not guarantee that the use of Internet access by guests is secured against access by third parties to guest data stored on the guest's terminal device or transmitted by the guest during use. It is the guest's responsibility to ensure the security that appears necessary.

8. Liability and limitation of liability of UZH

1 The UZH only provides access to the Internet via WLAN. UZH has secured its network against unauthorised use with state-of-the-art technical and organisational security measures.

2 To the extent permitted by law, UZH and its agents exclude all liability.

3 In particular, UZH accepts no liability for the continuous functioning of Internet access or for the uninterrupted or fault-free operation of Internet services. UZH also accepts no liability for damage to the hardware or software of the guest's terminal equipment, for any loss of data or other damage resulting from use of the internet access. UZH accepts no liability for the content of websites accessed by name or files downloaded via the internet services. Furthermore, UZH accepts no liability for any unauthorized third party taking note of, storing or modifying guest data transmitted via the WLAN and network.

9. Change of the terms of use

The current version of the terms and conditions of use, which are made available to guests upon registration, shall apply. If the terms of use are updated, the guest is automatically logged out on all registered devices. In order to continue using the Internet access, the guest must register again and accept the new terms of use. UZH reserves the right to change the terms of use at any time.

10. Severability Clause

If individual provisions of these terms of use prove to be invalid or illegal, the validity of the remaining provisions shall not be affected. In this case, the relevant provision shall be replaced by a valid provision which is as economically equivalent as possible. In the event of ambiguities or translation errors, the terms of use in the German language shall always prevail.

11. Place of jurisdiction

Place of jurisdiction is Zurich, Switzerland.

12. Applicable law

The contractual relationship is exclusively subject to Swiss law.
